Chine : Xi Jinping rêverait-il d’un État de droit ?

C’est à égalité avec la Défense que Xi Jinping a placé la justice dans son rapport au XXe congrès du Parti. Une première ! Avec cet objectif : faire de la Chine un État  fondé sur la loi, s’appuyant sur un système judiciaire cohérent et dont les juges seront effectivement au service du peuple. Le Parti est invité à mettre en cause une organisation judiciaire chinoise encore trop souvent défaillante, une révolution. Ce faisant, quel projet a-t-il en tête ? Pérenniser le régime qui doit s’adapter à son temps ? Ou bien instaurer une forme de démocratie où la loi prendra le pas sur l’appareil communiste ? On souhaiterait qu’il puisse en être ainsi et aussi improbable que cela soit, qu’un Xi Jinping tenté par la démocratie nous surprenne. 

In his report to the 20th Party Congress, Xi Jinping put justice on a par with defense. A premiere! With this objective: to make China a state founded on the law, relying on a coherent judicial system and whose judges will effectively serve the people. The party is asked to reconsider a Chinese judicial system that is still too often deficient. A revolution. In this respect, what project does it have in mind? To preserve the regime, which must evolve with the times? Or to establish a form of democracy where the law will take over the communist apparatus? We wish it could be so, and as unlikely as it may be, that a democracy friendly Xi Jinping would surprise us.

Chine : Création de  deux cours de justice internationales pour les nouvelles Routes de la soie

Après avoir créé la Banque asiatique d’investissement en infrastructure (BAII), la Chine poursuit le développement d’organisations internationales promues selon ses standards. La création de deux cours de justice internationales dédiées à l’arbitrage de conflits concernant les projets terrestres et maritimes de la Belt & Road Initiative (BRI) constitue une évolution importante en la matière.
